Conditions of Sale

All Advertising Sales Are Subject To The Following Conditions:

1. NO PORNOGRAPHIC OR ILLEGAL ASSOCIATIONS. Seller will not produce advertisements relating to pornography or illegal activities, products or services, or for companies which are associated with such. Seller reserves the right to refuse service.

2. MATERIALS. Buyer must provide all materials as listed in the advertising package descriptions, in a form usable by Seller, in advance of work starting.

3. WORK. Work starts 24 hours after receiving all materials in usable form from Buyer.

4. 3D ANIMATION. "Premium Animated" projects are based on the Buyer's concept, but to keep budget and production schedules reasonable at this budget range, it will be entirely Seller's design and implementation. Production design will be basic and straight forward. Custom work is available outside the package price schedule.

5. SCRIPT APPROVAL. Package price includes 1 (one) set of requested revisions to script copy, or to animatics/storyboard (as the case may be) which Buyer will approve prior to beginning production. Script/storyboard/animatics (as the case may be) will be deemed approved by Buyer 48 hours after they are made available for approval, unless Buyer responds within that time.

6. CHANGES AFTER SCRIPT APPROVAL. After script/storyboard/animatic approval, revisions or changes not due to Seller's error will incur additional hourly charges at the rate of $95.00 per hour for all 3D animation work, and $75.00 per hour for all other work.

7. EPISODES & AVAILABILITY. Seller will select the episode(s) on which the ad will be placed. It is intended that all episodes are available for many years on the internet, and Seller guarantees episode to be available to the public from websites associated with Seller for more than 18 months after original publication.

8. CAST. Seller selects the voice-over artist(s) and cast for all ads. Buyer may request a particular cast member, but this may require additional up-front costs, and could significantly raise the cost of the production. Except for unusual circumstances, Seller cannot utilize cast outside of those active as cast in the C2H show or other Stella James Studios productions, but Seller reserves the right to do where no such cast member is available for a shoot date.

9. EXTRA WORK & ADDITIONAL DESIGN. You may always request extra work, additions and more advanced design options, including additional or special voice over, or live-action scenes, and higher-concept design and production. Such will be at additional cost, payable 50% to 100% in advance (as the case may be at the time). Contact the producers to arrange a price quote.

9. TURNAROUND TIME. Turnaround time begins 24 hours after receipt of all required materials from Buyer, and does not include time spent waiting for Buyer's approval/revisions. The turnaround time for each package is:

  • For "Economy" and "Basic" Ads: 5 business days: 1 day to script copy / storyboard (if any), then 3 days to produce intermediate "proof" results; then 1 day to finish.
  • For "Basic Plus" Ads: 5 business days: 1 day to script copy / storyboard (if any), then 3 days to produce intermediate "proof" results; then 1 day to finish.
  • For "Premium Live" Ads - 6 business days: 1 day to script copy / storyboard (if any), then 3 days to schedule and produce intermediate "proof" results; then 2 days to finish.
  • For "Premium Animated" Ads - 3D and Motion Graphic ads: Turnaround times are dependent on the complexity of the project design and rendering requirements: for straight-forward spots, 10-14 business days would be expected: 3+ days to script copy / storyboard / animatics (if any), then 4+ days to produce intermediate "proof" results; then 3+ days to finish. Every aspect of animation is a time-consuming process and by its nature is subject to change, so this is a guideline only. Remember that simpler design specifications will generally yield simpler and more predictable results and time estimates.

All turnaround times are subject to extension in the case of Buyer's delay or concept change, re-shoots caused by failure of recording media, non-attendance by necessary cast or crew, or re-schedules/re-shoots at the request of Buyer (which may incur additional costs).

10. OUTPUT. Output will be in 1280x720 "progressive" frame high definition, at any one of 24, 24.97, 25, 29.97, 30 or other frames per second (as designed by Seller). Higher definition output, or "interlaced" output may be arranged for an extra cost for all ads. Seller will insert and display ad within context at any resolution/format convenient to that context.

11. COMMUNICATION / DELIVERY. Buyer will be given a user name and login to Seller's website, where Buyer will give specifications through Seller's form, upload all materials, and download all required scripts, storyboards, animatics, statements of account, preview and final copies of the ad, and other documentation or files. Buyer's use of the Seller's website will at all times be subject to the Terms of Service posted on the site. All communications and materials are effectively delivered when made available on Seller's website. Buyer's final copy will be delivered in downloadable form from Seller's website, encoded in .mov, .mp4 or .avi, or other digital format. A digital copy on data CD or DVD (ie., not "authored" to be a playable DVD) can be arranged on request for a modest charge.

12. RELEASE DATE & DISPLAY. An ad release date will be given to Buyer, which will be the date Buyer's ad first appears on the C2H show. Upon delivery, Buyer may immediately exercise the rights given in the Licesense below and may display the ad anywhere.

13. PAYMENT. Any Paypal method of payment is acceptable. You can pay by Credit card, debit card, e-check, or direct fund transfer, through the secured server of PayPal. If an electronic transaction is not possible, you can send a cashiers check drawn on an American bank or money order or check from an American Banking establishment or a postal money order.

14. LICENSE. Buyer gets an unrestricted license to copy, publish and distribute the produced ad in all media world-wide, and to transcode it into any digital video or analog video format for such use. No right is granted to re-edit the ad in any way whatsoever (including the addition of hyper-links or markers), or to re-title the ad, or to use individual parts of the ad, including but not limited to the sound track or any part of it, separate from the ad as delivered. Without limiting the foregoing, Buyer may not and may not permit adding any graphics, watermarks, cropping, or do any other thing which changes or obscures any video or audio in the Ad. Rights not granted in this License, if available, must be purchased in advance at additional cost from Seller, as such activities may affect third-party copyright, moral rights and other rights.

15. LIABILITY. Buyer represents and warrants that Buyer has full legal right to the use of all graphics, "service marks", trademarks, music and other materials provided to Seller for use in the ad(s), and will forever indemnify and hold harmless Seller from any and all liability, cost, loss, damage or expense relating directly or indirectly to the incorporation in of any of such materials into the ad(s). It is not possible and Seller makes no warranties or representations regarding the efficacy of any ads or ad campaign sold hereunder. The price charged by Seller is for production services and ad placement only, not for results of advertising exposure, real or expected. In no event will Seller be liable for more than the original cost of an ad actually paid to Seller.
